Client Service Agreement
Dashing Concierge upholds high ethical standards in order to provide Clients (the Client) with exceptional professional services. Please read carefully and understand our terms of service.
By checking the box on the Request Services form or by using our website and services you understand and agree to the following Client Service Agreement:
Services
Dashing Concierge (DC) is owned and operated by The DC Company LLC. DC provides services to their clients in accordance with the client’s requests, provided that all requests are, at the sole discretion of Dashing Concierge, for lawful, ethical and moral lifestyle services in respect of the personal errands of the client.
Dashing Concierge shall use its reasonable endeavors to meet agreed upon timescales for delivery of services, but such timescales shall be estimates only. Every effort, within reason, will be attempted to fulfill the booking request.
Dashing Concierge reserves the right to refuse any service requested; and/or withdraw the continuation of any service; provided that the Dashing Concierge informs the client of any refusal or withdrawal as soon as reasonably possible.
Dashing Concierge has absolute discretion to accept or reject any errand request.
Client shall provide proof of address, and photo identification in a form acceptable to Dashing Concierge upon request.
Client shall provide a completed and signed copy of a credit card authorization form for payment of services.
Services are based on an hourly rate, with a minimum booking of one hour at the rate of $50/hr, which may vary according to the day, time and/or location of the services. After the first hour of service for any one errand job the rate is then prorated to 15 minute increments and charged at a minimum of $12.50 per 15 minute increment above the first hour booking. Rates are submit to change and a notice will be sent to the client in advance of any such rate increase.
Restricted service
- Anything illegal, immoral, unsafe, dangerous or inappropriate. This is an honorable and reputable business. The safety of the concierge’s and others is not a negotiable item.
- We cannot transport people or pets in our vehicles. Our insurance does not cover this service. We can however, chauffer Clients using their vehicle under their insurance. No liability will be accepted by any Concierge or Dashing Concierge.
- We are not a cleaning service but can do light housekeeping duties such as organizing, tidying and light cleaning. If you require professional house cleaning services we can make recommendations.
- We cannot give you legal or accounting advice, or offer medical services. Seek professionals in these areas. Home care after surgery or after delivering a baby is helping the Client do the things in their home or outside errands that the Client cannot physically do, or just needs help with, while the Client is recovering. We cannot administer medication or any other services that requires a CNA, Nurses or Doctors license.
Liability
Dashing Concierge warrants that it will, always, exercise reasonable care and skill in providing the services and, as far as reasonably practical, such provision will accord with the client’s request and instructions.
Clients must rely on their judgement and discretion in selecting, hiring and using Suppliers (third party vendors and, or service providers). Dashing Concierge will not be responsible for any goods or services provided by the Supplier but will use its reasonable endeavors to assist clients in any subsequent dealings with Suppliers.
Contracts which clients enter into with Suppliers are independent and not connected to or subject to these Terms and Conditions. Dashing Concierge disclaims any and all liability for any act or omission of any Supplier or any loss incurred by a Client as a result of any act or omission of a Supplier hired by a Client.
The client understands that Dashing Concierge is not insured or licensed to operate/perform some tasks e.g: childcare, medical assistance and some transportation services etc.
Confidentiality
Dashing Concierge shall treat all confidential information that it holds in relation to the Client as confidential and applying the same security measures and degree of care to such Client Confidential Information as Dashing Concierge applies to its own confidential information; and not disclose the Client Confidential Information outside of the company to any other person without the Clients written consent.
Dashing Concierge shall abide by its own Privacy Policy. Please see our company website under the Privacy Policy tab.
Dashing Concierge may disclose Confidential Information only to the extent to complete the errand and as required by law, by any governmental or other regulatory authority or by a court or other authority of competent jurisdiction.
Data Collection
Clients should refer to the Dashing Concierge Privacy Policy for any information on how Dashing Concierge uses and protects client’s personal information provided to the company. We do not share or sell your information.
Any client of Dashing Concierge may request any information that we hold and what personal data we possess. Clients can also request that we: correct, erase or no longer use their personal data for marketing purposes. All data related queries must be sent in writing and sent to mydashingconcierge [at] g mail [dot] com.
Collection & Delivery service
Contents of any package must be disclosed to the concierge handling the collection or delivery. We will not handle any packages that contain illegal, dangerous, unethical, unlawful items or items that may be unsafe, cause harm or injure our concierge’s or the receiving person. Pick up and drop off addresses must be a reputable place of residence, business or hotel among public settings. All pick up and drop off locations must be safe to enter. Further more if the concierge feels in danger or uncomfortable at any time the client will be notified and another arrangement will be made. These are safety protocols for our concierge’s and others. By using our services you agree to this strict policy.
Pricing & Surcharges
Errand prices are based on the time needed to complete the task. A one hour minimum at $50/hr per concierge – After 1st hour, errand time is charged in 15 minute increments at the prorated amount of $12.50 (based on the $50/hr rate). This is our standard rate for errands completed during our normal business hours between 9am to 6pm, Monday to Friday except public/statutory holidays.
Clients are expected to give as much notice as possible in order to secure the booking for the time requested.
For errands required before or after our normal business hours a 30% surcharge is added to the hourly rate (total hourly rate for after hours service is $65/hr).
Cost of purchases are to be paid for by the Client and are not included in the hourly rate – see Expenses below.
Mileage is charged at $0.75/mile. If the errand takes place at your home within 6 miles of Lees Market Place in North Ogden – no mileage fee is charged.
Notary services are charged at $10 per signature, per page as, per Utah State law.
If an errand needs to be cancelled Client must provide sufficient notice of at least 2 hours. If costs are incurred from purchases already made, the Client is responsible for these costs.
The full price of services will be charged if you fail to provide any notice of cancellation plus any expenses already incurred. Your credit card on file will be charged.
As this service is on-call, for your convience, there may be times when current jobs are being completed and we may not be able to complete your job within the time frame you request. Every effort to accommodate will be given. We simply ask for your understanding should this occur.
Gratuity is not expected but always appreciated. Thank you.
Billing
All jobs must be paid prior to the work commencing. An estimated amount will be prepared with a link to complete payment. If the job ends up being longer than first anticipated or other expenses were incurred (i.e: mileage or purchases) another payment link will be sent for you to pay.
You will see the name The DC Company LLC show on your statement. Client credit card information must be up to date. If a new card is issued – a new authorization form must be completed.
Cash or check is accepted upon prior arrangement to approved Clients only. No cash or check on the first 3 errand jobs. A $35 service fee is charged for returned checks and the outstanding bill must be paid within 24 hours.
All jobs are to be paid prior to an errand job commencing unless otherwise agreed upon, as per the process above. Every effort is made to give you an accurate estimate before commencing any job however, the nature and variety of each job may, at times, go over what was first estimated.
Payments rendered are considered fully earned and non-refundable.
Expenses
Client is responsible for all purchases and third party vendor purchases.
Expenses incurred on behalf of Client are not included in any concierge fees and will be the Client’s responsibility. Should a concierge make a purchase on behalf of the Client, there will be a 6% service fee added to the purchase amount to be reimbursed by the Client for transaction and service fees we get charged to receive your funds. We recommend the Client pay for goods and services prior to the concierge collecting any item to avoid the 6% service fee or provide a payment method for a concierge to make the purchase on the Client’s behalf. Reimbursements must be paid on the same day as the service is rendered.
Reimbursable expenses may include, but not limited to, parking fees, excessive mileage (over 6 miles outside of Lee’s Marketplace North Ogden).
Non-Solicitation Agreement
Our employees are our biggest asset. For a period of one year following the termination of the Agreement, Client will not call on, solicit, or take away any of Dashing Concierge’s staff. Breach of this clause would cause liquidated damages of 25% of Client’s yearly package. The parties hereto expressly agree and acknowledge that actual damages for purposes of this Subparagraph would be difficult to ascertain and that the amount set forth above represents the parties’ reasonable estimate of such damages. This clause would in no way limit any other remedies available to Dashing Concierge.
Liability: Dashing Concierge agrees to provide services stated in this contract in a reliable and trustworthy manner. IN CONSIDERATION OF THESE SERVICES AND AS AN EXPRESS CONDITION THEREOF, CLIENT EXPRESSLY WAIVES ANY AND ALL CLAIMS AGAINST DASHING CONCIERGE, UNLESS ARISING FROM GROSS NEGLIGENCE ON THE PART OF DASHING CONCIERGE. Dashing Concierge will not perform work that is illegal or puts Dashing Concierge in danger. Dashing Concierge will not be responsible for any keys Client has asked to be mailed. Dashing Concierge will not be responsible for any damage inside or out of the home due to any act of nature.
Third Party Vendors: Dashing Concierge may contract third-party vendors to provide services requested. Dashing Concierge will use their best efforts to obtain qualified providers, but cannot guarantee the quality of services provided by others. Dashing Concierge will not be responsible for any damage caused by third-party such as but not limited to dry cleaning, food delivery, plumber, and furnishings. Dashing Concierge cannot be responsible for third-party appointments. If the third-party arrives later than the time specified, Dashing Concierge is not held liable and will be compensated for their time.
Emergencies: Client agrees to authorize Dashing Concierge to handle any emergencies that may arise. In the event Client cannot be contacted, Client authorizes Dashing Concierge to use their best judgment and to be available at the hourly rate to oversee the circumstances.
Expiration & Modification: This Agreement shall remain in effect until such time as one or the other Party provides written notice of cancellation. This Agreement may be modified or amended as necessary after negotiations initiated by either Party. If agreement is reached, only a written instrument signed by both Parties will modify or amend this Agreement. No waiver or modification of any of the express terms of this Agreement shall be effective unless it is in writing and signed by the Party against whom the waiver or modification is asserted; and each of the Parties irrevocably waives any right to assert any verbal waiver or modification by the other of any of the express terms and conditions of this Agreement. This agreement is severable so that if any provision hereof is deemed illegal or unenforceable, the remainder of the Agreement shall remain fully valid and in full force and effect.
For non-compliance of any of these terms Dashing Concierge can refuse service.
Additional Provisions: This Agreement shall be governed by and construed according to the laws of the State of Utah, and shall not be construed against the drafter. The parties agree that any suit or action relating to this Agreement shall be instituted and commenced exclusively in the federal or state courts in Weber County Utah, and the parties hereby waive the right to change such venue and hereby consent to the jurisdiction of such courts. ANY LIABILITY ON THE PART OF DASHING CONCIERGE AS DETERMINED BY A COURT OF LAW WILL BE LIMITED TO AN AMOUNT NOT TO EXCEED ONE MONTH’S RETAINER. If Dashing Concierge must bring suit or other action to collect on unpaid invoices or seek remedy of any other breach of contract, Dashing Concierge shall be entitled to an award of costs, reasonable attorney’s fees and interest at the maximum rate permitted by law in addition to any other relief awarded.
The terms and conditions of this Agreement may be modified or amended as necessary in writing and signed by both parties. By agreeing to this Client Service Agreement, I indicate that I understand, agree to and accept the terms and conditions as contained herein.
